PRESIDENTIAL DECREE No. 1292

CREATING BARANGAYS SAN MARTIN, STA. CRUZ, FATIMA, SAN PEDRO, SAN RAFAEL, STO. NIO AND CITRUS IN THE MUNICIPALITY OF SAN JOSE DEL MONTE, PROVINCE OF BULACAN.

WHEREAS, the creation of more self-reliant communities has been the primordial objective of the government to provide every possible opportunity and facility to hasten the pace of development throughout the country;

WHEREAS, Barangays Bagong Buhay and Minuyan in the Municipality of San Jose del Monte are comprised of vast territories and densely populated that the present barangay officials thereat have been unable to implement effectively national as well as barangay developmental projects and/or programs; and

WHEREAS, the necessity is felt, in order to maximize the efficacy of law and order and to expedite optimum development in said barangay to divide the same into smaller barangay units so as to enhance the progress and development of the localities involved;

WHEREAS, the creation of new barangays will contribute greatly to the maintenance of peace and order in the area.

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers in me vested by the Constitution, do hereby order and decree:

Section 1. There are hereby created out of the territory now known as Barangay Bagong Buhay in the Municipality of San Jose del Monte, Province of Bulacan, the following new barangays: San Martin, Sta. Cruz, Fatima, San Pedro and San Rafael, and out of the territory now known as Barangay Minuyan, same municipality, Barangays Sto. Ni and Citrus. The Director of Lands shall within four months from the approval of this Decree survey and determine the relative metes and bounds of the said new barangays, subject to the approval of the President of the Philippines.

Barangays Bagong Buhay and Minuyan shall remain as barangays and shall continue to exercise and discharge over the areas specified in the law of their creation, except the areas included in territory of the new barangays herein created.

Sec. 2. Except as hereinafter provided, all provisions of law now or hereafter applicable to regular barangays shall be applicable to the new barangays of San Martin, Sta. Cruz, Fatima, San Pedro, San Rafael, Sto. Ni and Citrus.

Sec. 3. The present elective barangay officials of Barangays Bagong Buhay and Minuyan shall continue to perform their duties as such officials in the newly created barangays until the barangay officials of said barangays shall have been appointed by the President. Such officials so appointed shall hold office until their successors shall have been elected in the regular elections for barangay officials following the issuance of this Decree and shall have qualified, unless sooner removed at the pleasure of the President. Such appointive officers and employees as may be necessary to organize or to complete the government personnel of Barangays San Martin, Sta. Cruz, Fatima, San Pedro, San Rafael, Sto. Ni and Citrus shall be appointed as provided for under existing laws.

Sec. 4. Upon the effectivity of this Decree, the proportionate share of Barangays San Martin, Sta. Cruz, Fatima, San Pedro, San Rafael, Sto. Ni and Citrus in the obligations, funds, assets and other property of Barangay Bagong Buhay and Minuyan, respectively, shall be transferred by the President to the newly created barangays upon the recommendation of the Commission on Audit.

Sec. 5. All laws or parts of laws as well as all executive orders or regulations inconsistent herewith are hereby repealed or modified accordingly.

Sec. 6. This decree shall take effect immediately.
